Privacy Policy
This Privacy Policy explains how the company “TONIC-Group” (hereinafter — “Website Administration”) collects, uses, and shares information about Users obtained through our owned and managed online interfaces (for example, the website, email, and other communication channels), including via the website www.tonic-adv.com (hereinafter — “Website”). Note that using the Website is also governed by the User Agreement.
I. Subject of the Privacy Policy
This Privacy Policy applies to the information that the Website Administration and Contractors receive from Users through the Website. Personal data must be provided only to access certain features and services of the Website, such as the feedback form.
If the User does not use such features or services on the Website, only information that cannot identify the user and is anonymized is collected, such as a list of visited web pages.
To access some other features of the Website, the User must provide information that allows identification (hereinafter — “Personal Data”): name and surname, age, email address, phone number, etc.
The User is responsible for the accuracy of the Personal Data provided to the Website Administration and Contractors. If false information is provided, the User will not be able to use all Website functions or receive useful information, and the Website Administration and Contractors will not be able to contact the User. For example, it is important to ensure that the User provides a current email address, as it is one of the main communication methods.
By providing Personal Data, the User agrees that the Website Administration and Contractors may collect, use, and disclose it in accordance with this Privacy Policy, the User Agreement, and the laws of Ukraine.
If the User does not agree with these terms, they have the right not to provide their Personal Data to the Website Administration and Contractors. In this case, some Website features will be unavailable to the User.
II. Consent to the Processing of Personal Data
By using the service and submitting the electronic form on www.tonic-adv.com, the User confirms that they have read and agree to the terms of the Privacy Policy and, in accordance with Article 11 of the Law of Ukraine “On Personal Data Protection” dated 01.06.2010 № 2297-VI, voluntarily give the Website Administration, Contractors, and their authorized representatives and licensees consent to process without any restrictions the Personal Data provided in the electronic form for the purpose of processing, in the “Clients” personal data databases maintained by the Website Administration and each Contractor.
Consent to the processing of personal data is provided by the User to ensure the implementation of civil-law relations, as well as relations in the field of advertising and marketing, in accordance with the Civil Code of Ukraine, the Law of Ukraine “On Advertising,” the Law of Ukraine “On Consumer Rights Protection,” and other regulatory acts.
The User grants the Website Administration, Contractors, and/or any third parties the right to provide any commercial and/or informational information about the activities of the Service, Contractors, and/or any third parties via email, telephone, SMS, or other communication channels.
The User also confirms their consent to the transfer by the Website Administration and Contractors of their personal data included in the “Clients” personal data databases to personal data managers and any third parties exclusively for the purpose stated above. The User consents to the transfer and processing of their personal data via cloud services (for example, Google, Amazon, iCloud, etc.), which are foreign entities involved in personal data relations. For the purpose of processing personal data via cloud services, the User consents to the cross-border transfer of their personal data by the Website Administration and Contractors.
The User does not require notification about the transfer (disclosure) of their personal data to managers and third parties included in the specified personal data database.
Consent to the processing of personal data is granted to the Website Administration and Contractors indefinitely.
By filling out and submitting the electronic form, the User confirms that they have been informed about the inclusion of their personal data in the “Clients” personal data databases maintained by the Website Administration and Contractors, the purpose of collecting and processing personal data (as specified in this document), as well as their rights under Article 8 of the Law of Ukraine “On Personal Data Protection,” according to which a personal data subject has the right to:
know the sources of collection, location of their personal data, the purpose of processing, and the location or residence of the owner or manager of personal data, or authorize designated persons to obtain this information, except as established by law;
receive information on conditions for access to personal data, including information about third parties to whom their personal data is transferred;
access their personal data;
receive, no later than thirty calendar days from the request date (except as provided by law), a response on whether their personal data is being processed and access to the content of such data;
submit a motivated request to the personal data owner objecting to the processing of their personal data;
submit a motivated request to modify or delete their personal data if it is processed illegally or is inaccurate;
protect their personal data from illegal processing and accidental loss, destruction, or damage, as well as from the provision of false information or information that damages the honor, dignity, or business reputation of an individual;
file complaints regarding the processing of their personal data with the Commissioner or in court;
exercise legal remedies in case of violation of personal data protection legislation;
make reservations limiting the processing of their personal data when giving consent;
withdraw consent to the processing of personal data;
know the mechanism of automated processing of personal data;
be protected from automated decisions that have legal consequences for them.
The User agrees that if complaints or claims arise regarding the processing of personal data, they will first attempt to resolve them with the Website Administration and Contractor through negotiations.
III. Confidentiality and Security of Personal Data
The Website Administration and Contractors take the confidentiality and security of Users’ personal data very seriously. The Website Administration and Contractors follow standard physical, electronic, and procedural security measures to protect Users’ personally identifiable information. Since absolute security cannot be guaranteed during data transmission over the Internet, the Website Administration and Contractors cannot ensure the complete safety of Users’ personally identifiable information: there is a risk that malicious actors may bypass our security systems or intercept data transmissions online. The User is responsible for keeping their login credentials confidential and bears full responsibility for this.
IV. Changes to the Privacy Policy
From time to time, the Website Administration reviews the measures to ensure privacy, including the provisions of this Privacy Policy.
All changes and updates take effect immediately upon publication on the Website. After making changes to the Privacy Policy, the Website Administration publishes the new version. The Website Administration recommends periodically reviewing this page to stay informed of the current Privacy Policy terms.
